Scottsdale Bay Club is a condominium community in Scottsdale, Arizona (part of the master-planned Scottsdale Ranch). This document is a 1991 amendment to the original 1984 declaration—it clarifies vehicle, maintenance, and architectural rules and allows the developer to add up to 108 additional units through 1997. The rules bind unit owners.
- What you own & maintain: You own your individual apartment unit; the association maintains common elements and carries master insurance. Each owner pays an equal share of annual assessments (capped at $1,320 in 1990).
- Vehicles & parking: No trailers, campers, boats, commercial vehicles, or inoperable cars. Vehicles must be garaged when on the property; if you have more than one, at least one must stay garaged. Standard pick-up trucks and sedans used for business/personal use are allowed with board discretion on signage.
- Garbage & trash: Trash must be regularly removed and kept in sanitary containers. Garbage cans and storage piles must be screened and hidden from view of other apartments and common areas.
- Exterior modifications: No personal TV or radio antennas without board approval. No exterior clotheslines or outdoor drying of clothes; no clothing hung on patios, balconies, or decks. No foil or darkening window screens; decks/patios cannot be used for storage.
- Maintenance & repairs: Garages must be kept clean and free of clutter. Car maintenance, power tools, and workshops are only allowed in enclosed garages, except for emergency work or minor repairs taking less than one day. Other work requires board approval.
- Voting & governance: Each apartment owner has one vote per unit in association affairs. First mortgagees must approve certain major changes, including assessment increases, alterations to common elements, and modifications to the condo structure.
- Future development: The developer (Cascade Financial Corporation) can add up to 108 additional apartments before December 31, 1997, as long as the first owner of each new phase is not the developer. New phases merge with existing common elements.
- What this document doesn't cover: This is an amendment to the 1984 original declaration—it does NOT include the full rulebook. Lease terms, pet policies, move-in rules, common area use, architectural review procedures, and other foundational condo rules are in the original 1984 declaration and earlier amendments.
