Trailside Estates at Manzanita Ranch is a single-family home subdivision in Scottsdale, AZ, governed by a homeowners association (HOA). This document creates the HOA, defines common areas (none), and sets rules for property use, assessments, and architectural control. It applies to all lot owners and residents.
- What you own & maintain: You own your lot and the house on it. The HOA maintains only the common area (none in this subdivision) and the exterior of perimeter fences along Cactus Road and 91st Street. You are responsible for all other maintenance on your lot, including landscaping and fencing.
- Assessments & fees: Each lot owner must pay annual assessments set by the HOA board. The maximum annual assessment started at $180 in the first year (1984) and increases annually by the Consumer Price Index. Special assessments require a two-thirds vote of owners. Unpaid assessments accrue 10% annual interest and become a lien on the lot.
- Use restrictions: Lots are for single-family residential use only. No business, commercial, or temporary structures allowed. No more than two domestic pets per lot (dogs, cats, household birds) that do not create a nuisance. No signs except one 'For Rent' or 'For Sale' sign of up to 5 square feet. No boats, campers, or commercial vehicles visible, except temporary parking of personal-use trucks.
- Architectural control: All new construction, alterations, fences, and landscaping must be approved in writing by the Architectural Control Committee. Plans must be submitted and are deemed approved if not rejected within 45 days. Minimum house size: 1,590 square feet of ground floor (excluding garages and porches). Fences must be cement block, not over 6 feet high, and gates no higher than the fence.
- Enforcement & violations: The HOA, developer, or any lot owner can enforce the rules through legal action, including damages and injunctions. The prevailing party is entitled to costs and attorneys' fees. The HOA can suspend voting or common area use for unpaid assessments. Violations can also lead to a lien on the lot.
- What this document doesn't cover: This document does not set any age restrictions (55+), rental minimums, lease terms, or income/affordability limits. It does not address amenities (pool, clubhouse) because there are no common areas. It is the full declaration for the subdivision.
