Desert Circle Condominium is a Sun City, AZ condominium community where you own a residential apartment (unit) within a multi-family building and share ownership of the common elements. This document is a compilation of amendments—from 2008 and 2025—that establish strict rental restrictions, detail the split between what you maintain versus what the association maintains, and require unit owners to carry property insurance.
- What you own & maintain: You own your residential apartment and are responsible for maintaining its interior, roof, patio, HVAC system, plumbing, electrical, walls, fixtures, foundation, ceiling, and garage/carport. The association maintains the common elements (landscaping, driveways, irrigation system, utility lines to the main connection) and performs exterior painting of the building.
- Leasing & rentals: No unit may be rented or leased, with a narrow exception: owners who were already renting when the rule adopted in January 2008 may continue renting, but their right terminates if they sell the unit, die, or stop renting. The board may permit a temporary lease only to alleviate hardship (death, transfer, etc.).
- Insurance you must carry: You must obtain property insurance on your unit and improvements, and provide proof to the association within 30 days of becoming an owner or at annual renewal; the board may impose penalties for non-compliance.
- Common elements insurance & liability: The association insures common elements at minimum 80% of actual cash value and carries liability coverage. If damage to common elements is caused by you, your guest, or your invitee, you are personally responsible for paying the association's insurance deductible.
- Assessments & late fees: You pay monthly assessments (as of 2008, $150/month). Unpaid within 15 days of the due date incurs a late charge of $15 or 10% of the unpaid amount, whichever is greater. The board may levy additional assessments if insurance proceeds are insufficient to repair common element damage.
- What this document doesn't cover: This is an amendment compilation and does not include the original declaration, bylaws, or rules and regulations. Those documents govern pet policies, architectural review, landscaping, and other community rules.
