Hayden Lane Villas is a small condominium community in Tempe, AZ (4 units) governed by a 1982 Declaration of Horizontal Property Regime. You own your individual unit's interior space (including appliances), a private patio or yard, a storage room, and an assigned parking space, plus a one-fourth undivided share of the common elements. The Association maintains shared areas and carries master insurance; you must follow rules on pets, vehicles, exterior alterations, and more.
- What you own & maintain: Each unit includes the airspace within interior surfaces (floors, ceilings, walls), plus a private patio/yard, storage room, and parking space. Owners must maintain their unit's interior, exterior walls and roof specific to their unit, patio/yard landscaping, and any appliances. The Association maintains all common elements (land, buildings, utilities, recreational facilities, etc.).
- Single-family use & leasing: Units may only be used as a single-family residence. Leasing to a single family is permitted, but no minimum lease term is specified in this document; the lease must comply with all other restrictions. No businesses, trades, or nonresidential uses are allowed.
- Pets & animals: No dogs, cats, or other animals may be kept without prior written Board approval for each animal. The Board may consider impact on neighbors and Common Elements, impose conditions, and adopt pet rules. Owners must prevent pets from defecating or urinating outside the owner's exclusive-use patio/yard area.
- Parking & vehicles: Only automobiles in operating condition may be parked in parking areas. No mobile homes, boats, RVs, trailers, trucks, or campers may be kept on the property for more than 24 consecutive hours (48 hours aggregate per week), except emergency repairs. Garages must be used for parking and storage only, not converted to living space. Street parking on Common Elements requires Board approval.
- Exterior alterations & architecture: No improvements, alterations, or changes to exterior appearance (including color, building materials, fences, walls, antennas, signs) may be made without prior Board approval. The Board may deny plans for aesthetic or other reasons. Overhanging vegetation less than 12 feet above ground requires approval.
- Assessments & fees: Annual assessments are levied uniformly per unit. Initial maximum annual assessment was $540 (subject to CPI increase). Special assessments for capital improvements require approval of 3/4 of units. Unpaid assessments become a lien on the unit and a personal obligation of the owner.
- Voting & membership: Each unit owner automatically becomes a member of the Association with one vote per unit owned. Cumulative voting is allowed in Board elections. Voting may be suspended for unpaid assessments or for up to 60 days for rule infractions.
- Nuisances & activities: No nuisances, odors, rubbish, loud sound devices, or activities that interfere with other owners are permitted. No clotheslines visible from neighboring property. No mineral exploration, and no operation of motorcycles on walkways except lawn equipment.
