Hughes Acres is a single-family residential subdivision in Tempe, AZ, governed by a 1964 Declaration of Restrictions that runs with the land. These are deed restrictions, not an HOA rulebook—there is no homeowners association, dues, or architectural committee described. The restrictions apply to all lot owners in Unit Three (Lots 250–437) and cover what you can build and how you can use your lot.
- Land use & permitted structures: Each lot is for one detached single-family dwelling plus a private garage for up to 3 cars. No building may be moved onto a lot from another location. Garages cannot be built before the dwelling unless a contract for the dwelling is in place. No house trailers are allowed.
- Minimum home size: The ground floor area of any dwelling must be at least 800 square feet, excluding open porches, pergolas, and attached garages.
- Setbacks: Front setback: at least 20 feet from front property line. Side setback for interior lots: at least 7 feet; for corner lots: at least 10 feet from the side street line and 5 feet from the interior lot line. Eaves, cornices, coolers, and chimneys may project up to 3 feet from side walls, but no closer than 2 feet to any lot line. Unenclosed roofed carports: front supporting members at least 19 feet from front property line, side setback at least 3 feet; an enclosed storage room in the carport can't exceed 7 feet parallel to the side lot line.
- Prohibited uses: No business of any kind may be conducted in or from any residence. No stores, offices, hospitals, nurseries, sanitariums, theaters, saloons, churches, or other religious uses are allowed. Lots cannot be resubdivided into parcels smaller than 60 feet wide at the minimum setback line and 6,000 square feet, except for public utilities or combining contiguous lots.
- Animals & livestock: No livestock (horses, cows, sheep, goats), poultry, rabbits, or swine may be kept on any lot.
- Duration & amendment: These restrictions run with the land until January 1, 1994, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them in whole or in part.
- What this document doesn't cover: This is only a set of deed restrictions. There is no homeowners association, no dues or assessments, no architectural review committee, no rules about leasing, pets (beyond livestock), parking (beyond garage), or common areas.
