This is a Declaration of Restrictions for Knoell Tempe Unit Six, a single-family residential subdivision in Tempe, Arizona. The document sets binding covenants on all lots (1049–1316) that run with the land and are enforceable by any owner. It covers what can be built, how lots can be used, and basic design standards, but does not create a homeowners association or provide for common areas or assessments.
- What you own & maintain: Each lot is a single-family residential lot. You own your lot and the dwelling you build. No association maintains common areas; homeowners are responsible for their own property.
- Building & size requirements: Only one detached single-family dwelling and one private garage (max 3 cars) per lot. Minimum dwelling floor area is 800 square feet of livable space. Structures must be new construction; no moving buildings onto a lot.
- Setbacks & lot dimensions: Front setback: 25 feet from the front property line. Side setback on interior lots: 7 feet. Corner lots: 10 feet from the side street line, plus 7 feet from interior lot line. Eaves and chimneys may project up to 3 feet, but no closer than 2 feet to any lot line. Carport front setback: 25 feet from supporting members. Minimum lot width at setback line: 60 feet; minimum lot area: 6,000 square feet. No resubdivision into smaller lots except for public utilities.
- Use restrictions & prohibited activities: No business, office, store, hospital, nursery, sanitarium, theater, saloon, or church is allowed. No commercial activity may be conducted from a residence. No house trailers or mobile homes. No livestock (horses, cows, sheep, goats), poultry, rabbits, or swine. A construction yard and model home are permitted temporarily until all lots are built out.
- Duration & amendment: The restrictions run with the land and automatically renew every 10 years after January 1, 2003, unless a majority of lot owners vote to change them. Violations can be restrained by court action and damages awarded, but a violation does not affect existing mortgages.
