What Knoell Ville Monaco's governing documents say
Knoell Ville Monaco is a townhome community in Tempe, AZ; you own your dwelling and lot but share maintenance responsibility for exterior elements through party walls and common areas. The homeowners association maintains roofs, painted exterior walls, fences, drainage, and private utilities, funded by per-lot assessments capped at 10% annual increases without a member vote.
- What the association maintains: The association is responsible for roofs, exterior painting, fences, drainage systems, party wall repairs (shared proportionally with neighbors), and private sewers and water lines from your property line to public utilities.
- Assessments & payment: Annual per-lot assessments are capped at 10% annual increases without a vote; increases above 10% require a majority member vote. Special assessments for capital improvements can be spread over up to 7 years and require majority approval. Unpaid assessments become liens and can be foreclosed.
- Party walls (shared walls with neighbors): Repair and maintenance costs for walls between units are split proportionally based on use. If fire or casualty damages the wall, restoration costs are shared proportionally. An owner who negligently exposes the wall to the elements bears the full weatherproofing cost.
- Architectural review & alterations: Board approval is required for any building, fence, pool, or exterior alteration; the Board has 30 days to approve/deny, or approval is deemed given if they don't respond within 30 days.
- Residential use & restrictions: Properties are restricted to residential use only—no commercial activity, businesses, or temporary structures are allowed. You may display one "for sale" or "for rent" sign (max 5 sq ft); no other advertising or business signs permitted.
- Pets: Household pets such as dogs and cats are allowed, provided they are not kept for commercial purposes or breeding.
- Exterior appearance & yard maintenance: You must maintain your front yard (mowed, landscaped). The association can hire contractors to maintain neglected yards and charge the cost to your assessment. Trash, equipment, and clotheslines must be screened or confined to rear patios.
- Parking: Each lot must include at least a double carport; carports cannot be enclosed.
