What Sevilla Court's governing documents say
Sevilla Court, Phase I (Phoenix, AZ) is a single-family residential HOA in a master-planned community where you own an individual lot and share ownership of common areas (roads, landscaping, etc.) maintained by the Association and funded through assessments. Lot owners are automatically Association members with one vote per lot; the developer retains enhanced voting power during the build-out phase.
- What you own & maintain: You own your individual dwelling and lot, responsible for maintaining your home's interior and exterior, landscaping, utilities, paving, and all structural elements within your unit and lot. The Association owns and maintains all common areas including roads, driveways, landscaping, drainage systems, utilities, street lighting, and recreational facilities.
- Assessments & fees: Annual assessments start at a maximum of $35 per lot and are levied equally. The Board can increase the maximum annual assessment by up to 20% per year without member approval; increases beyond 20% require approval from 51% of voting members. Special Assessments require approval from 67% of voting members. Assessments are due in equal periodic installments (monthly or semi-annually as set by the Board), with a late fee of the greater of $15 or 10% of the unpaid amount if payment is 15+ days late. Unpaid assessments create a lien on your lot.
- Architectural review & modifications: Prior written approval from the Architectural Control Committee is required for any exterior modification or alteration, including paint color, landscaping, fencing, HVAC units, solar panels, and other construction affecting exterior appearance. The Committee has 45 days to respond; if no decision is made within 45 days, the request is automatically approved. You may freely remodel or paint the interior of your home any color you wish, unless the change is visible from neighboring properties.
- Use restrictions: The property is restricted to single-family residential use only, defined as persons related by blood, marriage, or legal adoption, or no more than 3 unrelated persons in a common household. No business, trade, occupation, or non-residential use is permitted on any lot. The Declaration includes additional restrictions on animals, vehicles, signs, temporary structures, outdoor burning, and other matters.
- Voting rights & membership: Every lot owner is automatically an Association member with one vote per lot. The developer initially holds Class B voting rights (3× votes), which automatically convert to standard Class A voting on whichever occurs first: 90 days after Class A member votes equal Class B votes, two years after the Declaration is recorded, or when the developer elects to convert. Voting and common area use rights can be suspended if your assessments are delinquent or if you violate Association rules.
