What Marina Heights's governing documents say
This is a reciprocal easement agreement between Arizona State University (ASU) and SunCor Development Company governing a shared driveway, utilities, and signage for two adjacent parcels—the ASU Parcel and the SunCor Parcel (planned as the Marina Heights mixed-use development, which may include residential, office, hotel, and retail). It does not establish rules for residents or unit owners; instead it binds the parcel owners (landowners or their successors) and covers construction, maintenance, cost-sharing, and insurance for the shared improvements. Prospective homeowners or tenants should be aware that this document governs only the shared infrastructure and does not contain typical HOA rules.
- Shared Driveway & Access: A shared drive (the Shared Drive) will be built on easement areas on both parcels to provide reciprocal non-exclusive vehicular and pedestrian access. The drive cannot be used for parking, stopping, or standing of vehicles, and traffic must be managed to avoid stacking. Each parcel owner must monitor traffic entering/leaving its parcel, and failure can result in fines ($500-$2,500 per stoppage) and traffic control measures.
- Cost Sharing & Maintenance: Construction costs for the Shared Drive and common utilities are split 50% (Allocable Share) between the two parcel owners. The constructing owner pays upfront and is reimbursed by the non-constructing owner when that owner sells or obtains a building permit. Ongoing maintenance is the SunCor Parcel Owner's responsibility after the payment trigger date, with the ASU Parcel Owner paying 50% of costs. Each owner must repair damage caused by its own users.
- Signage Easement: ASU grants SunCor a permanent easement for a monument sign at the driveway entrance identifying the Marina Heights project. The sign may include tenant identification panels for ASU's tenants, with ASU paying for those panels. No other signage is allowed in the easement area without both owners' consent.
- Insurance Requirements: Each parcel owner must carry commercial general liability insurance (minimum $5 million per occurrence), workers' compensation, and automobile liability insurance ($1 million combined single limit). Property insurance on the Shared Drive is also required, with specific coverage during construction (builder's risk). Policies must name the other owner as additional insured and be primary.
- What This Document Doesn't Cover: This agreement does not contain any rules for residents or unit owners—no pet restrictions, leasing terms, age limits, architectural review, or homeowner obligations. Those rules would be found in separate covenants, conditions, and restrictions (CC&Rs) for the individual parcels within Marina Heights.
