McKemy Place is a single-family home HOA in Tempe, AZ — you own your lot and the house, but the association handles exterior maintenance of the homes and common areas. Homeowners must pay annual and special assessments, and the HOA has architectural control over changes.
- Assessments & fees: Annual assessments start at up to $360 per lot (as of original 1983), adjustable annually by CPI or by a 2/3 vote of members for larger increases. Special assessments for capital improvements require 2/3 approval. Assessments are a lien on the property and bear 6% interest if unpaid 30 days past due.
- Exterior maintenance: The association handles paint, roof repair/replacement, exterior surfaces, trees, shrubs, grass, walks, and other exterior improvements (excluding glass and refrigeration). If damage is caused by an owner's negligence, the cost is added to that owner's assessment.
- Architectural review: No building, fence, wall, or other structure, nor exterior alteration, may be made without prior written approval of the Board or an architectural committee. Approval is deemed given if not decided within 30 days of submission.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally by owners using the wall. If one owner negligently damages a party wall, that owner bears the full cost.
- Parking & vehicles: Each lot is entitled to two assigned parking spaces on the common area, with ingress and egress rights. The association permanently assigns two spaces per dwelling.
- Leasing & rentals: Owners may delegate their common area use rights to tenants (who reside on the property). The document does not set a minimum lease term or restrict rentals otherwise.
- Amendment & duration: The covenants run for 20 years from recording, auto-renewing for 10-year periods. Amendments require 90% of lot owner approval in the first 20 years, then 75%. Any amendment must be recorded and, prior to that, approved by the Tempe City Attorney.
