What The Commons on Lemon's governing documents say
The Commons On Lemon is a 29-unit condominium community in Tempe, Arizona, where you own your individual unit's interior and share ownership of the buildings' common elements through the association. The community operates as a horizontal property regime under Arizona law, with each unit owner automatically becoming an association member.
- What you own & maintain: You own your unit's interior (floors, walls, ceiling, interior plumbing/electrical serving only your unit) and hold an undivided 1/29th interest in common elements. The association maintains the roof, bearing walls, exterior, shared mechanical systems, parking, landscaping, and recreational facilities.
- Monthly assessments & special assessments: Assessments fund common element maintenance and master insurance. The initial cap is $80/month per unit; annual increases follow a CPI formula, but the board can seek a larger increase with 67% owner approval. Unpaid assessments accrue 12% annual interest, up to 25% late charges, and attorney fees, and create a lien on your unit.
- Voting & membership: Each unit owner is automatically an association member with one vote per unit. The developer initially holds Class B membership with 3 votes per unit; this automatically converts to standard Class A 120 days after Class A owners achieve majority voting power or 5 years after the first sale, whichever comes first.
- Parking allocation: Each unit is allocated up to 2 parking spaces (including one assigned space). Guest parking is managed by the board under its established rules.
- Insurance: The association maintains master casualty insurance at 100% replacement cost for all common elements and units, plus public liability of at least $1,000,300 per occurrence, and flood insurance unless unavailable or the property is outside a flood hazard area. Owners may obtain additional insurance for personal property and unit improvements.
- Use of common areas: You have perpetual rights to use common elements for access to and enjoyment of your unit. The board can suspend these privileges (up to 60 days) for rule violations or for unpaid assessments, and can suspend your voting rights if assessments remain unpaid.
- Destruction, condemnation & restoration: If the building is substantially destroyed, condemned, or becomes obsolete, the association undertakes restoration unless all owners and mortgagees consent to sell. If sold, proceeds are distributed to owners in proportion to the cubic footage of their units.
