What The Trails at Scottsdale Community Association's governing documents say
The Trails at Scottsdale is a standard single-family home HOA in Tempe, AZ. The governing documents are a Declaration of Covenants, Conditions and Restrictions (CCRs) and Bylaws that apply to all lot owners and their tenants. They define property rights, maintenance obligations, and use restrictions for the community.
- Property use & restrictions: All lots are for single-family residential use only; no business activities are permitted. The minimum floor area for a dwelling is 975 square feet (excluding porches, garages, carports, patios) unless approved by the architectural committee.
- Architectural review: Any building, fence, wall, structure, or exterior change (except keeping the same color) must be approved in writing by the Board or an architectural committee. Changes to existing external colors also require committee approval. If construction is completed without prior approval, it is deemed automatically approved 30 days later if no lawsuit to stop it is filed.
- Signs: Only one sign of up to 5 square feet, advertising the property for sale or rent, is allowed to be displayed to public view, unless otherwise approved by the Association.
- Parking & vehicles: Boats and trailers must be parked on an improved surface; parking cannot cover more than 35% of the front yard area or 30 linear feet of lot frontage. No vehicle may be occupied for permanent living purposes. Vehicles parked in the front yard must be at least 1 foot from sidewalks, 3 feet from non-sidewalk curbs, and 1 foot from side lot lines. Parking/driveway surfaces must be dust-free (concrete, asphalt, cement, brick, sealed aggregate pavement, or 3 inches of crushed rock) with a permanent border. Inoperable or abandoned vehicles visible from neighboring property or streets are prohibited; license plates must be current.
- Motor vehicle repair: Except with Association approval, no motor vehicle, boat, or trailer may be constructed, reconstructed, or repaired on a lot if visible from neighboring property, unless the repair is completed within two days.
- Pets: No livestock or poultry; dogs, cats, or other household pets are allowed but not for commercial purposes and must not cause noxious odors. Owners must comply with City of Scottsdale ordinance: pets must be leashed, cleaned up after, and not allowed to bark incessantly.
- Leasing & rentals: All leases must be in writing, for at least 60 days, and expressly subject to the governing documents. The lease must state that violation of the documents is grounds for eviction. Owners must submit a rental registration form for each new tenant/lease. The owner remains liable for tenant violations; the Association may require the owner to evict for violations.
- Assessments & fees: Annual assessments are set by the Board and may increase up to 5% per year (or up to the CPI increase, whichever is greater) without a member vote. Special assessments for capital improvements require majority member approval. Assessments not paid within 180 days of due date bear 18% annual interest. Unpaid assessments become a lien on the property, subordinate to a first mortgage. The Association can sue to collect or foreclose.
