What Garden Lakes Commercial Plaza's governing documents say
Garden Lakes Commercial Plaza is a commercial condominium-style development in Tolleson, AZ, consisting of 8 lots zoned for commercial use. This document binds all owners of lots within the plaza, governing use, maintenance, and appearance of the property. The rules are designed for business owners and investors, not residential tenants.
- Permitted uses & restrictions: Each site may be used only for commercial purposes allowed by zoning. No junk yards, hazardous uses, or offensive activities (odor, noise, etc.) are permitted. Fast food restaurants (e.g., McDonald's, Taco Bell) are banned unless all site owners approve in writing.
- Architectural review & approvals: All exterior improvements, modifications, or landscaping must be approved by the Manager in advance, with detailed plans submitted. Approval is based on design harmony, adequacy, and conformity to the overall plan. No changes to approved plans are allowed without prior written approval.
- Parking & loading: Each site must maintain sufficient parking for its own employees, customers, and visitors. Parking on adjacent public streets is prohibited. Uses that attract more parking than available spaces on the site are not allowed.
- Owner maintenance obligations: Each owner must keep their site clean, free of rubbish and weeds, maintain landscaping, paint and repair structures, and keep driveways clean. Outdoor storage of materials is prohibited unless screened from view by a solid barrier.
- Common area maintenance & assessments: The Manager maintains the small common area (along Indian School Road and storm water easements). Each owner pays a monthly proportionate share of estimated expenses based on site land area, plus a 15% management fee. Delinquent payments create a lien on the site.
- Boundary walls & shared walls: Walls between sites are boundary walls shared equally by adjoining owners. Repair and replacement costs are split equally, but each owner paints their own side. Damage caused by one owner is their sole responsibility.
- Subdivision & lot modifications: No lot may be further subdivided or split without prior written approval from the Manager and the city. Lot boundary relocations are reserved for the Declarant only.
