Heritage Village II is a single-family home HOA community in Tolleson, AZ — you own your lot and house, and the association maintains common areas and front-yard landscaping. This Amended and Restated Declaration (2007) updates the original 1977 covenants and binds all owners, residents, and their guests.
- Use & residential character: Lots are for single-family dwellings only, max two stories. No trade or business on a lot unless it is home-based, not detectable from outside, no customer visits, and consistent with residential character. Leasing a lot is not considered a business.
- Pets: Only commonly accepted household pets allowed, no commercial breeding. Pets must be leashed outside; owners must immediately pick up waste. Animals causing annoyance may result in fines.
- Parking & vehicles: No commercial vehicles (over 3/4 ton, signage >2 sq ft, visible work equipment), boats, trailers, campers, or inoperable vehicles may be parked on a lot if visible from other lots or streets. Overnight on-street parking is prohibited. Vehicles must fit in the garage.
- Architectural review: Any exterior change (addition, fence, wall, repainting) requires prior written approval from the Architectural Committee and Board. Plans are deemed approved if not acted on within 30 days. Unauthorized modifications must be undone within 90 days of notice, or the association may restore at owner's expense.
- Maintenance responsibilities: Association maintains common areas, front-yard landscaping (irrigation system), and private streets. Owner maintains the lot, residence, patio, rear yard, all interior and exterior structures, water/sewer lines serving the lot, and obtains property insurance.
