Rolling Hills is a single-family residential and recreational community near Monticello, KY, designed for small farmsteads, cabins, and peaceful rural living. It is not a heavily restricted subdivision, but it has specific covenants that must be followed. Owners are responsible for maintenance of private access roads, and no subdivision of parcels is allowed without the seller's written consent.
- Allowed uses & restrictions: Each parcel is for single-family residential and recreational use only. Commercial activity is prohibited, including commercial marijuana growing, greenhouses, stockyards, and commercial wood harvesting. All uses must comply with Kentucky State Building Codes and county regulations.
- Dwellings & temporary structures: Only one single-family dwelling per five acres of land is allowed. No structure of temporary character (tent, lean-to, etc.) may be used as a residence, but travel trailers, RVs, portable cabins, or campers are permitted for recreational use and may remain on a parcel for no more than 21 days per calendar year. Temporary shelters are allowed while a home is under construction.
- Livestock & pets: Residents may keep livestock and pets as long as they do not create a nuisance. Up to three dogs are permitted per contract. No swine may be raised, bred, or kept in a commercial capacity. Ranching (e.g., horses, cattle) is allowed if the parcel is fenced, and livestock numbers must be reasonable for personal consumption. Livestock must not contaminate natural streams or springs.
- Waste & derelict vehicles: Waste must be kept in closed containers; burying or dumping of garbage, oil, or any solid/liquid waste is prohibited. No derelict vehicles (non-running or unlicensed) may be kept on a parcel unless stored in an enclosed garage.
- Environmental protection & tree cutting: Trees with a trunk diameter of six inches or more (measured two feet above ground) may only be cut if dead/dying, or for building sites, access roads, fire prevention, utilities, views, or recreation. No more than 20% of any parcel may be cleared. Cut timber may not be removed or sold. Excavation or sale of rock is prohibited. Natural streams and springs may not be dammed, rerouted, or polluted.
- Hunting: Hunting on foot is allowed on individual parcels but is prohibited from or on any access roads within the property. Hunters must obtain required state licenses and follow seasons.
- Road maintenance & access: Owners are individually responsible for maintaining private access roads on their parcels. Commercial vehicles or heavy equipment are not permitted unless necessary, and any resulting road damage must be repaired at the owner's expense (or the property owner's expense if the user is not the owner). Delivery trucks are allowed.
- Subdivision & setbacks: No parcel may be subdivided without the express written consent of the Seller. No structure (except fences and mailboxes) may be built within 70 feet of any access road or within 50 feet of any property boundary. Fences must not encroach on road easements.
