What Rolling Hills Heights's governing documents say
This document creates the Rolling Hills Heights Sewer District Users Association, a special-purpose association for owners of a few lots (Sewer Lots) in Paradise Valley, AZ, to share and maintain a private sewer system. It is not a standard HOA or condominium governing document—it covers only sewer-related rights, obligations, and costs. The rules bind the lot owners (Class 2 Members) and run with the land.
- Purpose & membership: The Association exists to maintain the private sewer system serving the Sewer Lots. There are two membership classes: Class 1 (a single individual, James McGrath) and Class 2 (owners of the Sewer Lots). Only Class 2 Members have voting rights and use rights, subject to payment of assessments.
- Use of the sewer system: Class 2 Members have the right to use the private sewer system, which passes with ownership of their lot. The Association may suspend use rights for nonpayment of assessments or failure to maintain lot-side equipment, and may terminate use for delinquency.
- Maintenance responsibilities: The Association maintains the shared sewer line and related equipment (the Private Sewer System). Each Class 2 Member is solely responsible for maintaining the sewer improvements on their own lot (pumps, motors, pressure tanks) and must keep them in good working order. If a member fails to do so, the Association may repair and charge the owner, or terminate sewer use.
- Assessments & fees: The Board sets annual assessments, which must be at least $100 per lot per year. Assessments are due Dec. 31. Delinquent members must pay interest (18% per annum or the highest legal rate) and may have their unpaid amounts advanced by other members, creating a personal obligation and an assessment lien on the lot.
- Liens & enforcement: The Association may record a Notice of Assessment Lien against a delinquent lot and foreclose like a mortgage. Personal liability for assessments survives sale or foreclosure. A delinquent member loses voting rights and sewer use until paid.
- Adding lots: Additional lots may be added only if the sewer system has certified capacity and the City approves. New lot owners must pay compensation split between the Class 1 Member and the original developers, and they become Class 2 Members.
- Transfer of rights: Sewer use rights cannot be transferred separately from the lot—they automatically pass with the lot. Lot splits are not recognized by the Association.
- Amendments: The Declaration may be amended by a vote of 75% of the Class 2 Members.
