Cinco Soles is a single-family residential community in Phoenix, AZ, with five individually owned lots and shared common area maintained by the Cinco Soles Community Association. This declaration governs all lots and common areas, binding owners, tenants, and occupants.
- Use restrictions & minimum home size: All lots must be used exclusively for single-family residential purposes. Each home must have a floor area of at least 3,000 square feet (excluding open porches, garages, and guest houses). No commercial activities are allowed on the property.
- Architectural review: No construction, exterior additions, modifications, or front-yard landscaping may begin without written approval from an architectural committee appointed by the Board. Plans showing design, materials, and location must be submitted; the committee has 30 days to respond.
- Assessments & fees: Each lot owner pays a pro-rata share (1/5) of annual and special assessments for common area maintenance, reserves, and insurance. The initial maximum annual assessment was $300 per lot. Special assessments require approval of at least three-fourths of the Board and ratification by four of the five owners. Delinquent assessments bear interest at 15% per annum and become a lien on the lot.
- Parking & vehicles: Boats, trailers, campers, and recreational vehicles must be stored only in the rear half of the lot or enclosed by a wall at least 6 feet high. No inoperable vehicles or vehicle repairs are allowed on driveways. Garages and carports may not be enclosed into living space unless off-street parking is provided elsewhere.
- Pets: Household pets are allowed but not for commercial purposes. No livestock (horses, cows, sheep, goats, etc.) may be kept on any lot.
- Exterior maintenance & storage: Owners are solely responsible for maintaining their lots and homes. Items such as clotheslines, pet facilities, playground equipment, air conditioners, solar panels, and storage tanks must not be visible from neighboring properties or streets. Chain-link or metal fencing visible from 62nd Place or neighboring property is prohibited.
