Mountain Shadow Resort is a single-family home community in Phoenix, AZ. The Declaration of Restrictions (1964) governs lot use, building standards, and a homeowners' association (Management Board) that enforces rules, maintains common areas, and has approval rights over sales, leases, and exterior changes.
- What you own & maintain: You own your lot and residence. You must maintain the residence and all improvements. The Management Board maintains landscaping, streets, grounds, and street lighting via assessments.
- Building & design standards: All dwellings must be one story, brick or masonry, with a minimum ground floor area of 2,000 square feet (excluding porches, pergolas, garage). Only one dwelling per lot. Setbacks: front wall 10–15 feet from front property line; side walls at least 7 feet (10 feet if on a street). No separate structures (including dog houses) are allowed.
- Architectural review: No structure or improvement may be built until the design, location, and materials are approved in writing by the Management Board. Exterior changes (enlarging, remodeling, adding) require written permission from Mountain Shadow Co. and the Management Board. Landscaping changes also need approval, but interior patio landscaping may be done freely.
- Leasing & rentals: Any lease, sublease, or occupancy change requires written notice to the Management Board and approval. The Board has 15 days to approve/disapprove and has a right of first refusal to purchase or lease the property on the same terms.
- Pets: Only house pets belonging to owners are allowed, and only if kept within the residence with Management Board approval. Pets must be leashed when exercised. If a pet causes annoyance by barking or otherwise, the Board can order its removal after receiving complaints and verifying them.
- Parking & vehicles: No trucks, buses, trailers, boats, campers, or vehicles other than passenger automobiles are permitted on the premises, except for deliveries.
- Use restrictions: Lots are restricted to high-class single-family residential use. No business activities, hospitals, sanitariums, or care facilities are allowed. No signs (including 'For Sale' signs), towers, clotheslines, or outdoor trash receptacles are permitted except on trash pickup days. No fences, hedges, or walls may be erected without approval. Swimming pools are allowed only in specific areas as shown on the plat.
- Assessments & management: The Management Board can levy assessments on lot owners to hire staff, purchase supplies, and maintain common areas. Failure to pay assessments or taxes gives the Board a lien on the property, foreclosable like a mortgage. The Board consists of 10 members (9 elected homeowners, 1 appointed by Mountain Shadow Co.). The Board also has the power to approve or disapprove exterior antennas.
