What Mountain Shadows Acres's governing documents say
Mountain Shadows Acres is a standard single-family homeowners association (HOA) in Phoenix, AZ — you own your lot and the house on it, and the association has limited common-area maintenance responsibilities. The HOA is governed by the Mountain Shadows Acres Homeowners Association, which has the power to levy annual and special assessments on each lot. The declaration was recorded in 1981 and runs with the land for 30 years, automatically renewing every 10 years unless terminated by 60% of lot owners.
- Association membership & voting: Every lot owner automatically becomes a member. Each lot gets one vote; the developer (Declarant) gets five votes per lot until Class A (non-developer) votes equal or exceed Class B votes. If joint owners cannot agree on a vote, they lose that vote.
- Assessments & fees: The association can levy annual assessments and special assessments for capital improvements. The maximum annual assessment initially is $120 per improved lot and $60 per developed lot. Without a membership vote, the annual assessment can increase up to 15% each year. Any increase above 15% requires a two-thirds vote of members present at a meeting. Special assessments for capital improvements also require a two-thirds vote. Assessments are a personal obligation and a lien on the lot.
- Maintenance responsibilities: The association maintains the 'Outside Right-of-Way Area' (the portion of streets right-of-way between pavement and boundary lines) with landscaping and the perimeter wall. If the association fails to maintain, each adjacent lot owner must maintain that portion at their own expense.
- Document term & amendments: The covenants run for 30 years from recording (1981), with automatic 10-year renewals unless terminated by 60% of lot owners within six months before expiration. Amendments require a two-thirds vote of all lots and must be recorded.
