This is a standard single-family HOA declaration for Sawyersmill, a residential subdivision in Apex, NC. It binds all lot owners and governs what you can build, how you use your property, and what you pay to the homeowners' association.
- What you own & maintain: You own your lot and house; the association owns and maintains the common areas (including private roads, if any) and permanent open space. You must keep your lot neat and free of grass over 6 inches, and the association can step in and charge you if you don't.
- Assessments & fees: Annual assessments start at a maximum of $420 per lot, can rise up to 20% per year without a vote, and are due quarterly. Special assessments for capital improvements require a 2/3 vote. Unpaid assessments accrue 18% annual interest plus a $25 monthly late fee and become a lien on your property.
- Architectural review: Any building, fence, hedge over 3 feet, wall, walk, antenna, clothesline, or other structure or planting needs written approval from the Architectural Control Committee before construction. No outside clotheslines, no commercial signs except small 'For Sale'/'For Rent' signs, no exposed above-ground tanks (except approved pools), no trailers or outbuildings without approval, no chain-link fences without approval, and no loud or noxious activities.
- Parking & vehicles: No street parking for owners' cars. Boats, trailers, campers, and recreational vehicles must be parked in a garage or screened from view. Inoperative vehicles cannot be parked or stored on lots or streets.
- Pets & animals: No livestock, stables, dog runs, or poultry houses without written permission. A 'reasonable number' of household pets is allowed, as determined by the board, provided they are not raised for commercial purposes.
- Leasing & rentals: Leases must be in writing, for the entire house, and for at least 90 days. Transient or hotel use is prohibited. Leases must state that they are subject to the declaration and bylaws.
