This is an amendment to the covenants for Copperleaf, a single-family HOA subdivision in Cary, NC. It mainly affects the developer's rights and the transition to homeowner control, not day-to-day rules for residents.
- Developer control & transition: The developer's control period ends when 159 lots have homes with certificates of occupancy sold to non-builders, or six months after a majority of homeowners vote to end it, whichever comes first. The developer keeps some rights for annexing land and approving new home construction until January 24, 2014.
- Community expansion: The developer may annex up to 30 additional lots across Morrisville Parkway, bringing the total to 176 lots. The new area will be called Copperleaf Glen and will have its own MLS designation.
- Developer payments to association: The developer will pay $25,000 for common area improvements and $250 per new home sale for lots 142-176 (up to $8,750 total). The developer also covers any association expenses that exceed revenues for the new lots until the area is financially self-sufficient.
- Architectural review: After January 24, 2014, the developer gives up architectural approval rights for existing lots (1-141), and the association's Architectural Review Committee takes over. The developer retains approval for new home construction until control transfers.
