This is a declaration of covenants, conditions, and restrictions for The Courtyards on O'Kelly Chapel, a planned community of single-family detached homes in Cary, NC, governed by a homeowners association (HOA). It establishes the rules and standards that apply to all owners, residents, tenants, and guests, and it includes an age-restriction requirement for occupancy.
- Age restriction (55+): At least 80% of occupied units must have at least one permanent occupant aged 55 or older. Exceptions allow a surviving spouse or household members to remain after death, divorce, or incapacitation of the qualifying occupant. Owners must provide proof of age and the association can enforce this, including eviction.
- What you own & maintain: You own your lot and unit (including garage). You are responsible for maintaining your unit's interior, windows, doors, decks, courtyard patio areas, HVAC systems, and interior pest control. The association maintains common areas, unit exteriors (roof, foundations, exterior walls), gates, fences, landscaping, sidewalks, driveways, and retaining walls.
- Architectural review: Before making any exterior changes (structures, fences, landscaping, grading, etc.), you must obtain written approval from the Declarant (developer) or its designee, and later from an architectural review committee. Interior remodeling does not require approval, but changes to screened porches or patios visible from outside do.
- Leasing & rentals: The declaration does not prohibit leasing, but the association may restrict leasing of multiple lots by the same owner and may require a minimum lease term of up to 12 months. Tenants must comply with all governing documents, and leases must include that requirement.
- Flags & political signs: You may display the U.S. or North Carolina flag (up to 4x6 feet) on your lot, but no flagpoles are allowed. Political signs are permitted, subject to time, place, and manner restrictions. Religious and holiday displays are also protected.
- Assessments & fees: The association levies general assessments to fund common expenses, and may levy special or specific assessments. A non-refundable capital contribution is required upon initial purchase of a lot (other than by the Declarant). Assessments are a lien on the property.
