This is a supplemental declaration for Evans Farm, a townhome community in Cary, NC, that adds new townhome lots to the existing HOA and sets up a separate service area with its own assessments. It applies to owners of these townhome lots, defining what the association maintains and what owners must maintain and insure.
- What you own & maintain: You own your townhome lot and are responsible for the interior, entry doors, exterior glass, decks/patios, garage doors (except painting), and any landscaping or improvements you add. The association maintains the exterior of the dwelling (roof, siding, gutters), lawns, driveways, sidewalks, fences, and private streets, plus common areas.
- Assessments & fees: In addition to the regular HOA assessment, each townhome lot pays an annual Service Area Assessment of $975 in the first year it's levied. The board can adjust this annually, with increases over 10% requiring an 80% owner vote to reject.
- Insurance requirements: You must carry fire and extended coverage insurance on your dwelling and improvements at 100% insurable replacement value, plus liability insurance of at least $300,000 per occurrence, naming the association and declarant as additional insureds.
- Party walls & shared walls: Walls shared between townhome lots are party walls; repair and maintenance costs are shared equally by the adjoining owners. You have an easement to enter your neighbor's lot for necessary party wall work, and disputes go to arbitration.
