This is the declaration of covenants, conditions, and restrictions for MacGregor Townhomes, a townhome community in Cary, NC, established in 1974. It governs the homeowners association, common areas, and all lots, and applies to current and future owners.
- What you own & maintain: You own your lot and the townhome on it. The association maintains the common areas and provides exterior maintenance for each lot, including roofs, gutters, exterior surfaces, trees, shrubs, and walks, but not glass surfaces. You may maintain your entrance yard, but the association can revoke that right if you don't keep it neat.
- Assessments & fees: You must pay annual assessments and possible special assessments for capital improvements. The maximum annual assessment was $300 per lot until 1975, after which it can increase with the Consumer Price Index plus 5% without a vote, or higher with a two-thirds vote. Assessments are a lien on your property, and unpaid assessments can lead to suspension of voting rights and use of recreational facilities.
- Architectural review: You must get written approval from the association's board or architectural committee before building, erecting, or making exterior changes to any structure, fence, or wall. If they don't respond within 60 days, approval is considered granted.

- Party walls: Walls on lot lines are party walls. Repair and maintenance costs are shared proportionally by owners who use the wall. If a wall is destroyed, any owner who used it can restore it, and others who use it must contribute. Disputes are settled by arbitration.
