This is a 2023 amendment to the Declaration of Covenants, Conditions and Restrictions for Pritchett Farm, a single-family homeowners association (HOA) in Cary, NC. It updates specific rules about unlawful activity, architectural review procedures, construction timelines, and how the declaration itself can be amended. This is not the full rulebook—it only changes certain sections of the original 2016 declaration.
- Unlawful activity & nuisances: No unlawful activity is allowed on any lot or common property. Owners must avoid unreasonable annoyance or interference with neighbors' quiet enjoyment, obey local noise ordinances, and not obstruct doorways, walkways, or streets. Hunting, trapping, discharging firearms or bows and arrows, and outdoor fires (except grills or as allowed by rules) are prohibited.
- Architectural review process: The Architectural Control Committee (ACC) must send denial notices in writing (hand-delivered, mailed, or emailed) and specify the grounds for denial. Approved plans are kept by the ACC, and other sets are returned to the applicant.
- Construction deadlines: New construction must be 'dried-in' (roofing, windows, siding, trim) within 120 days of starting, and fully complete within 12 months of ACC approval. If delayed beyond a year, the ACC can rescind approval after notifying the owner within 30 days. Minor projects (no structural framing) must start within 60 days of approval and be substantially complete within 90 days.
- Reconstruction after damage: If a home is damaged or destroyed, the owner must start reconstruction within 4 months and substantially complete it within 12 months, restoring the exterior to match its prior appearance. The ACC may allow changes if they benefit the whole property.
- How the declaration can be amended: The declaration can be amended by a 67% vote of the association's voting power, unless a higher percentage is required by the declaration or state law. The developer (Declarant) must consent to amendments while it owns any lot, and during the period of declarant control, the Declarant can amend unilaterally.
- What this document doesn't cover: This is only an amendment, so it does not include the full set of HOA rules—such as assessments, pet restrictions, leasing rules, or maintenance obligations. Those are in the original 2016 declaration and any other amendments.
