What Mitchner Hills's governing documents say
Mitchner Hills is a single-family home HOA in Clayton, NC, governed by a Declaration of Covenants, Conditions, and Restrictions. This document is the full rulebook for homeowners, covering property use, assessments, and architectural controls.
- What you own & maintain: You own your lot and home; the HOA maintains common areas (including private streets, medians, and open space) and carries master insurance on common property. Owners must maintain their own lots and keep them mowed and clean.
- Assessments & fees: Annual assessments start at $30 per lot, can rise up to 5% per year without a vote, and are due monthly. A $100 working capital fee is paid at closing and may be required on resale. Delinquent assessments accrue 6% interest and can become a lien on your property.
- Architectural review: Any new building, fence, or exterior change needs written approval from the Architectural Committee (plans must be submitted; if no response in 30 days, approval is deemed given). No metal buildings, mobile homes, or modular homes are allowed.
- Building & lot rules: Only one single-family detached home per lot, max 3 stories, with a garage for up to 3 cars. Minimum finished area: 1,000 sq ft for one-story, 1,150 sq ft for two-story. Setbacks follow county rules, and lot lines can be adjusted up to 10%.
- Land use & business: Lots are for residential use only. No commercial or professional businesses, but in-home businesses are allowed if run by residents, no signs, and no customer visits. No signs except temporary 'for sale' signs.
- Parking & vehicles: No trucks, pickups, boats, trailers, or motor homes parked on public streets. Boats/RVs must be in the backyard and screened from view. No inoperable cars parked overnight. No tractor-trailers overnight anywhere.
- Pets: Only house pets allowed; no more than two dogs. Dogs outside must be fenced or leashed.
- Fences & appearance: Fences can't extend past the front setback line or closer to the street than the rear corner of the house without approval. No metal fences. Garbage cans must be in the backyard, and satellite dishes over 24 inches are not allowed unless approved.
