Parsons Chase is a single-family home subdivision in Durham, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners and sets out rules for assessments, exterior maintenance, architectural control, and use restrictions. It is the full rulebook for the community.
- What you own & maintain: You own your lot and home. The association maintains common areas and provides exterior maintenance for each lot, including roofs, gutters, exterior surfaces, trees, shrubs, grass, walks, mailboxes, and fences installed by the declarant or association. You are responsible for maintaining your rear yard if you fence it in, and you may not plant vegetation in the front yard without prior written approval.
- Assessments & fees: The maximum annual assessment starts at $720 per lot and can increase up to 12% per year without a vote. Special assessments for capital improvements require a two-thirds vote of each class of members. Assessments are a lien on the property and a personal obligation of the owner at the time they fall due. A working capital fund payment equal to two-twelfths of the current annual assessment is required at the first sale closing.
- Architectural review: No building, fence, sign, wall, or other structure may be erected or altered without written approval from the Board or an architectural committee. Plans must be approved within 30 days or approval is deemed granted. No 'For Sale' or 'For Rental' signs are allowed on the property or in windows.
- Use restrictions: Properties must be used for residential purposes only. No obnoxious or offensive activity is allowed. Dogs, cats, or other household pets are permitted but not for commercial purposes, and animals must be leashed on common areas. Dwellings must have a minimum floor area of 750 square feet for one-story homes and 900 square feet for multi-story homes.
- Parking & vehicles: Each lot owner is entitled to use up to two automobile parking spaces, unless more are required by city code. The association may permanently assign one parking space per dwelling.
- Party walls & joint driveways: Party walls and joint driveways are shared, with repair and maintenance costs shared proportionally to use. Disputes are settled by arbitration.
- Insurance & reconstruction: The association carries casualty and liability insurance on the townhomes and common areas. If a casualty occurs, the association is responsible for reconstruction or repair, and special assessments may be levied without a vote if insurance proceeds are insufficient.
- Amendment & enforcement: The declaration runs with the land for 20 years and automatically renews for successive 10-year periods. Amendments require 90% of lot owners' approval during the first 20 years, and 75% thereafter. The association or any owner can enforce the covenants.
