It is not a homeowners association rulebook; it governs only the KFC parcel's use and maintenance, and it binds the property owners, not residents or tenants.
- What this document covers: This is a private agreement between two commercial property owners, not a community association. It restricts how the KFC parcel can be used and requires the owner to maintain it, but it does not create any HOA or rules for residents.
- Use restrictions: The KFC parcel cannot be used for a long list of businesses (e.g., office supply stores, gyms, movie theaters, residential uses, car washes, laundromats, bars, manufacturing, medical offices, etc.) while certain anchor tenants (Staples, Dollar Tree, Roses, Dental Works, Boost Mobile) lease space in the shopping center. These restrictions run with the land and bind future owners.
- Maintenance & appearance: The KFC parcel owner must keep the property, landscaping, and buildings in a neat, clean condition consistent with a well-maintained restaurant. Dumpsters and rooftop equipment must be screened, and if the business goes dark for more than 90 days, the shopping center owner can control the lighting.
- Parking & access: The two properties grant each other mutual access and parking easements, but the KFC parcel's drive-through lanes are excluded. Parking is for customers and employees only, not for trucks or similar vehicles.
