This is a declaration of covenants, conditions, and restrictions for Triangle Business Center, a commercial/industrial development in Durham, NC, established in 1983. It governs the use and development of building sites for office, light industrial, and related purposes, and it binds all current and future property owners within the tract.
- Permitted uses: The tract is restricted to office, office/warehouse, distribution, light industrial, assembly/fabrication, and research/development facilities. Commercial uses require written approval, and prohibited uses include manufacturing of paper, factories, foundries, slaughterhouses, car lots, and storage of explosives.
- Architectural review: All buildings, structures, signs, and other improvements must be approved in writing by the Declarant before construction or alteration. Plans must include architectural, site, grading, landscaping, utility, sign, and use details. If no decision is made within 60 days, plans are deemed approved.
- Setbacks & building lines: Buildings must be set back at least 100 feet from public street rights-of-way and 75 feet from side and rear property lines. Parking is not allowed within 50 feet of street property lines or 10 feet of other property lines, unless approved.
- Parking & loading: No parking is allowed on public or private streets. Each owner must provide on-site parking: 4 spaces per 1,000 sq ft of office/administrative or retail space, and 1 space per 1,000 sq ft for distribution/manufacturing. Loading docks cannot face public streets, and all driveways and parking areas must be paved.
- Construction standards: All buildings must be masonry construction or equivalent, with exterior walls finished in precast/tilt-up concrete, brick, stone, or glass. Unpainted metal siding is prohibited. Landscaping must be installed within 90 days of occupancy and maintained, including tree size minimums.
- Outside storage & signs: Outside storage is prohibited without written approval and must be screened. Waste must be kept in closed metal containers. Signs require approval, must be identification (not promotional), and flashing, moving, or rooftop signs are banned.
- Assessments & maintenance: The Declarant may levy assessments up to 2 mills per square foot per year (adjusted for inflation every 5 years) to maintain common areas, enforce restrictions, and provide landscaping, lighting, and entrance signs. Unpaid assessments become liens on the property.
- Enforcement & duration: Restrictions run with the land and are enforceable by the Declarant or any owner. Violations are considered nuisances, and the prevailing party in enforcement actions can recover attorney's fees. The restrictions last until 2001, then auto-renew every 10 years, and can be amended by owners of more than 50% of the acreage (with Declarant's consent).
