What Tanglewood Owners Association Inc's governing documents say
Tanglewood is a planned residential community in Durham County, NC, governed by a homeowners association (HOA) under the North Carolina Planned Community Act. This declaration applies to all owners, residents, tenants, and guests, and covers attached single-family dwellings and common areas. It establishes the HOA's authority, property rights, and rules for living in the community.
- What you own & maintain: You own your lot and the attached dwelling on it. The association owns and maintains the common areas (e.g., streets, stormwater facilities, landscaping, amenities) and also maintains certain exterior elements of your home, as specified in Article 6. Party walls shared between attached homes are maintained jointly by the adjoining owners.
- Leasing & rentals: You may rent your lot, but leases must be in writing for at least 12 months, and you must provide the association with tenant info and a copy of the lease. Short-term rentals (30 days or fewer) are prohibited. The owner remains responsible for all assessments and rule compliance.
- Common area use & restrictions: All owners have a right to use the common areas, but the association can limit guest numbers, charge fees for facility use, and suspend usage rights for unpaid fines or rule violations (after notice and hearing). Owners cannot use common facilities while their lot is rented.
- Architectural review: An Architectural Committee has approval authority over new construction, modifications, and alterations. You must get approval before making exterior changes to your lot or home.
- Assessments & fees: The association levies annual assessments to cover common expenses, including maintenance, insurance, and stormwater facilities. Special assessments may also be levied. Failure to pay can result in fines, suspension of voting rights and common area use, and liens.
- Enforcement & fines: The association can impose fines up to $100 per day for violations (after a 5-day grace period), suspend voting and facility use, and use self-help to cure violations. It can also evict tenants who violate rules.
- Subdivision & time-sharing restrictions: Lots cannot be subdivided or partitioned without association consent, and time-sharing or other sequential ownership arrangements are prohibited.
- What this document doesn't cover: This excerpt does not include specific architectural guidelines, detailed rules and regulations, or the full text of the association's bylaws. It also doesn't specify the amount of annual assessments or any age restrictions.
