This is a supplemental declaration for Pagehurst Subdivision, Phase 3B1, a single-family home community in Durham, NC. It adds specific rules for these lots on top of the master Pagehurst Phase 3A HOA declaration, so it's part of a larger rulebook.
- Minimum home size: New homes must have at least 1,100 sq ft of enclosed floor area (excluding garage, porches, decks, etc.) for one-story homes, or 1,350 sq ft for homes over one story. The developer can allow variances up to 20%.
- Zero lot line easements: Many lots have a zero lot line (no setback on one side), so neighbors get a 15-foot-wide easement along that boundary for construction, repairs, and maintenance. The benefiting owner must restore any damage and indemnify the neighbor.
- Developer's reserved rights: For 15 years, the developer can enter lots to fix drainage or surface water issues, including cutting trees or grading, with reasonable notice and restoration. The developer can also annex more property into this declaration.
