Grays Creek is a planned single-family residential community in Fuquay-Varina, NC, governed by a homeowners association (HOA). The rules apply to all lot owners and occupants, covering assessments, maintenance, use restrictions, and architectural review. This is the full declaration of covenants, conditions, and restrictions for the community.
- Assessments & fees: Annual assessments start at $400 per lot, with a maximum of $450 until Dec 31, 2014, then auto-increase 10% each year. Builders pay 25% of the regular assessment; the declarant pays no dues. Special assessments require a 2/3 vote of all owners.
- Leasing & rentals: Lots may be leased, but all leases must have a minimum term of 12 months. Tenants must acknowledge and comply with the Declaration, Bylaws, and rules; the HOA can evict tenants on the owner's behalf and assess costs to the owner.
- Architectural review: No exterior construction, alteration, or addition is allowed without written approval from an Architectural Review Committee. Plans must be submitted and approved within 60 days or approval is deemed granted. The committee can withhold approval for any reason, including aesthetics.
- Parking & vehicles: Parking on streets is prohibited. Commercial vehicles, boats, RVs, trailers, and inoperable vehicles must be kept in enclosed garages. Garage doors must stay closed except when entering or exiting. Boats, RVs, or trailers left for more than 3 consecutive days may be removed at the owner's expense.
- Pets & animals: Only dogs, cats, and usual household pets in reasonable numbers are allowed, as determined by the Board. No commercial breeding. Dogs must be leashed when outside, and pets that cause damage or injury cannot be walked in the community.
- Signs & political signs: Political signs are allowed but limited to 10 square feet, cannot be placed earlier than 60 days before an election, and must be removed within 7 days after. Other signs are restricted; no signs on common property without HOA consent.
- Tree removal: Trees more than 4 inches in diameter (measured 2 feet above ground) cannot be removed without Architectural Review Committee approval. Flowering trees (e.g., dogwoods) of any size also require approval. Exceptions apply for trees within 10 feet of drainage areas, septic fields, sidewalks, residences, driveways, or lake high-water lines.
