This is a declaration of protective covenants for Maggie Run Subdivision Phase IV, a single-family home HOA in Fuquay-Varina, NC. It binds all lot owners in this phase, who automatically become members of the existing Maggie Run Homeowners Association and share its common pool and obligations.
- Allowed uses & construction standards: Lots are for single-family, stick-built homes only (max 2 stories). Minimum heated area is 1,800 sq ft (one-story) or 2,200 sq ft (two-story), plus a two-car garage. Exteriors must be brick, stone, or cement siding (no vinyl except trim). Construction must start within 9 months of deed and finish within 360 days, or you may owe $50/day.
- Architectural review: All plans for dwellings, fences, pools, outbuildings, and landscaping must be approved in writing before construction. Approval is deemed given if no response within 30 days. Outbuildings are limited to one per lot, max 1,000 sq ft and 1.5 stories, with materials matching the main house.
- Pets & animals: Only dogs, cats, or other household pets are allowed; no livestock or poultry. You may keep up to two outdoor dogs or cats, but they must be in an approved fenced area.
- Parking & vehicles: No inoperable vehicles may sit on a lot for more than 30 days. Boats, RVs, and trailers need approval and may require screening. Mini-bikes, go-carts, and ATVs are allowed but cannot be operated on streets or lots. No vehicles over 10 tons (except delivery).
- Leasing & rentals: Renting an entire dwelling is allowed, but you cannot subdivide the house or rent out individual rooms, floors, or lofts.
- Landscaping & maintenance: Yards must be kept mowed and neat; front yards extend to the street pavement. The HOA can do required maintenance and bill the owner. No visible clotheslines, and mailboxes must be uniform and purchased from the Declarant.
- HOA dues & assessments: Annual assessments start at $120/year per lot, but can be increased as needed. Special assessments require a 2/3 vote. Unpaid assessments accrue 10% interest and become a lien on the property (subordinate to mortgages).
- Common pool & amenities: All lot owners have use of the existing community pool. The HOA may charge fees for use and can suspend privileges for unpaid assessments or rule violations.
