What Balfour's governing documents say
This is a declaration of covenants, conditions, and restrictions for Balfour East, a townhome community in Durham, NC, part of a larger master-planned community called the Villages of Cornwallis. It binds all lot owners in Balfour East, who automatically become members of the Balfour East Townhomes Association. The document outlines the rights and obligations of owners, including assessments, maintenance duties, and use restrictions.
- What you own & maintain: You own your townhome and lot, but the association provides exterior maintenance for each townhome, including painting, roof replacement, and care of walks, trees, and shrubs. You are responsible for maintaining any fenced or enclosed rear yard, and you must get approval before planting vegetation in front of your home.
- Assessments & fees: Each lot owner pays an annual assessment that includes a subdivision portion (for Balfour East) and a Villages portion (for the master association). The initial subdivision portion was capped at $26.67 per lot through 1986, and increases are limited to 7% per year without a membership vote. Special assessments may be levied for capital improvements or to purchase and reconstruct substantially destroyed townhomes.
- Leasing & rentals: The document does not restrict leasing or rentals, but owners may delegate their use of common areas to tenants. A 'For Rent' sign is allowed under terms set by the board.
- Pets: The document does not mention pets or pet restrictions.
- Parking & vehicles: Each lot is entitled to use up to two parking spaces. Boats, trailers, campers, motor homes, trucks, or tractors cannot be parked on public or private streets, and can only be parked in designated areas on the property.
- Architectural review: Any construction, alteration, or installation of improvements (including fences, walls, and screens) requires prior written approval from the Villages Association or its architectural committee. Approval is deemed given if no response within 45 days of submission.
- Use restrictions: Each townhome must be used as a single-family residence only. No business, industry, or trade is allowed, except that a resident may operate an office with board and city approval. No signs may be displayed except 'For Sale' or 'For Rent' signs as allowed by the board.
- Party walls: Walls on lot dividing lines are party walls, and repair costs are shared proportionally by the owners who use them. Disputes are settled by arbitration.
