Woodchase is a standard single-family homeowners association (HOA) in Fuquay-Varina, NC. This declaration sets the rules for homeowners, covering property use, assessments, and architectural control. It applies to all current and future owners of lots in the community.
- What you own & maintain: You own your lot and the single-family home on it. The association maintains common areas (like open space, medians, and stormwater facilities) and can enter your property to fix exterior maintenance if you fail to do so, charging you for the cost.
- Assessments & fees: You must pay annual and special assessments. Annual assessments are shared equally among lots, but lots without a completed home pay only 25% of the normal rate. A $100 one-time contribution is collected at closing. Unpaid assessments accrue 18% annual interest and can lead to a lien and foreclosure.
- Leasing & rentals: Leases must be in writing, state they are subject to the declaration and HOA rules, and run for at least six months. Renting out your home is allowed, but renting individual rooms is not.
- Architectural review: Before building, altering, or repairing any structure, fence, wall, or exterior lighting, you must get written approval from the Architectural Committee or Declarant. If they don't respond within 45 days, approval is deemed given.
- Use restrictions: Lots are for residential use only. No mobile homes, temporary structures, or businesses (except home offices that don't disturb neighbors) are allowed. No clotheslines outside, and no signs except one temporary 'For Sale' or 'For Rent' sign per lot (max 24x36 inches).
- Parking & vehicles: No inoperable vehicles, commercial vehicles, trucks, trailers, or boats may be parked or stored outside. They must be kept in a garage with the door closed. No vehicle repairs on your lot except emergencies.
- Pets: You may keep up to two dogs, three cats, and a reasonable number of other household pets, but not for commercial breeding. The HOA can ban any pet it deems dangerous or a nuisance.
- Antennas & satellite dishes: Antennas and satellite dishes are generally prohibited, but small dishes (one meter or less) for satellite TV or broadband are allowed if placed in attics, rear yards, or other inconspicuous locations, with some flexibility if signal quality requires.
