What Sandy Springs Community Association Inc's governing documents say
This is the declaration of covenants, conditions, and restrictions (CC&Rs) for Cardinal Grove, a single-family home community in Raleigh, NC, governed by the Cardinal Grove Homeowners Association, Inc. It establishes the rules for property use, maintenance assessments, architectural control, and common area management that apply to all lot owners.
- What you own & maintain: You own your lot and home; the association maintains the common areas, including a storm water lake, and carries liability insurance of at least $1,000,000. Owners are responsible for taxes on their lots, including any common area easements on them.
- Assessments & fees: Annual assessments fund common area maintenance and other community needs. The initial maximum was $420/year for Class A lots (occupied homes) and $105/year for Class B lots (unbuilt or model homes), with annual increases capped at 10% unless two-thirds of owners approve more. A one-time working capital fee equal to 1/6 of the annual assessment is due at closing.
- Architectural review: No building, fence, wall, exterior alteration, or major landscaping may begin without written approval from the Declarant (or later the association). Approval is deemed given if no response within 30 days. A review fee up to $75 may be charged.
- Leasing & rentals: Renting your home is allowed, but tenants must occupy the residence as their principal residence in Wake County. Leased properties' votes are limited to 49% on any association matter.
- Common area use: Owners have an easement to use common areas, subject to association rules. The association can suspend use rights for unpaid assessments or rule violations (up to 60 days). Owners cannot remove vegetation, erect structures, or otherwise alter common areas without permission.
- Lender protections: First mortgage holders have rights to inspect association records, receive notices of delinquencies or insurance lapses, and must approve certain actions like selling common property or changing assessment methods.
- What this document doesn't cover: This excerpt does not include details on pet restrictions, parking rules, rental lease minimums, or age restrictions. Those may be covered in the association's bylaws or rules and regulations not provided here.
