Barefoot Bay is a single-family home subdivision in Holden Beach, NC, governed by a homeowners association (HOA). These covenants, conditions, and restrictions (CC&Rs) run with the land and apply to all lots in the subdivision. The HOA maintains private streets and common areas, funded by annual dues.
- Use restrictions: All lots must be used exclusively for single-family residential purposes. No lot may be divided or subdivided, except that a lot may be split into two portions and conveyed to adjoining lot owners, with the combined property treated as one lot.
- Building & home standards: Site-built homes must be at least 800 square feet (excluding porches) and have exterior construction completed within 6 months. Manufactured homes are allowed but must be no more than 5 years old at placement (unless approved), and must be underpinned with brick within 90 days. No temporary houses, trailers, tents, or outbuildings are permitted except during construction.
- Pets & animals: Only usual domesticated household pets are allowed. No livestock or other animals. Pets must be kept on a leash or within fenced areas, respecting setback requirements.
- Property maintenance & nuisances: All lots must be well-maintained; no unattractive growth, rubbish, or debris. Buildings must be maintained and painted. No stale garbage or conditions conducive to flies or rodents. No noxious or offensive activities, and nothing that becomes a nuisance to neighbors.
- Vehicles & parking: No stripped, partially wrecked, or junk motor vehicles (or parts) may be parked or kept on any street or lot.
- Setbacks & utilities: Front setback: 25 feet; side yard setback: 5 feet. All homes must have underground power service. Heating oil tanks must be placed at the rear of the home, concealed from the road. Clotheslines are allowed only at the rear and must be specially designed.
- HOA dues & assessments: Annual property owner's dues are $50 per year, payable on or before February 15. If multiple lots are combined into one residential lot, only one due is owed. The HOA may impose additional assessments for street maintenance, which become a lien if unpaid.
- Streets & common areas: All streets are private, not dedicated to the public. The HOA maintains the streets and common areas. Lot owners have an easement to use the streets. The HOA may set rules for street use.
