This is a declaration of maintenance covenant, stormwater easement, and agreement for maintenance and replacement contribution for stormwater control facilities, recorded for the Knightdale Station development in Knightdale, NC. It is an ancillary document that binds the property owners and the community association to maintain stormwater facilities for the benefit of the Town of Knightdale, not a full set of community rules.
- Stormwater maintenance responsibility: The association (and ultimately each lot owner) is responsible for maintaining the stormwater control facilities in compliance with the Town's UDO and the approved maintenance manual. The town has a right to enter the property to inspect and, if necessary, perform maintenance after notice and an opportunity to cure.
- Assessments & liens: The association must levy assessments to cover stormwater maintenance costs, including insurance and replacement contributions. Unpaid assessments become a lien on the lot after 30 days, and the town can enforce collection and foreclosure.
- Replacement fund: A General Replacement Account is established with the town, funded by an initial payment and annual contributions, to cover major repairs exceeding $19,052.92. Withdrawals require town consent and must be replenished.
- Insurance: The owner of the stormwater facilities (or the association) must maintain liability insurance of at least $1,000,000.
- Penalties for non-compliance: Failure to maintain the stormwater facilities can result in daily civil penalties and other enforcement actions by the town, and each lot owner is jointly and severally liable for maintenance costs.
