What Emerald Pointe's governing documents say
Emerald Pointe is a single-family home HOA in Wake Forest, NC. These documents are the association's bylaws, amendments, and architectural standards—they tell you how the HOA is run and what you must get approved before changing your home or yard.
- HOA governance & meetings: The HOA is run by a 3-person board elected by members. Annual meetings are held at 7:30 p.m., with 15 days' written notice. A quorum is 1/10 of each membership class's votes. Special meetings can be called by the president, board, or 1/4 of Class A members.
- Assessments & liens: The board sets annual assessments at least 30 days in advance. Unpaid assessments accrue 6% annual interest after 30 days past due, and the HOA can foreclose its lien or sue the owner personally. Owners can't escape assessments by not using common areas.
- Architectural review: Any exterior change—fences, decks, pools, sheds, paint, landscaping—needs written approval from the Architectural Committee (3+ members) before starting. The committee has 30 days to respond; if it doesn't, approval is deemed given. Appeals go to the Board, which decides within 48 hours.
- Fences & structures: Fences must be wood or vinyl, natural or stained (no painting), max 6 feet high, and can't extend past the front of the AC unit. Utility sheds must match the house's siding, be in the backyard, and max 120 sq ft. Metal buildings and metal swingsets are prohibited.
- Parking & vehicles: Vehicles must park on driveways, not grass. Motorhomes only overnight; RVs, boats, and ATVs must be in the garage or rear of lot. Commercial trucks over 1-ton and inoperable vehicles are not allowed on lots or rights-of-way.
- Pets & recreation: No specific pet rules appear in these documents. Basketball goals must be in driveways (not streets), and playground equipment needs approval and should be in the backyard.
- What this document doesn't cover: These are bylaws, amendments, and architectural standards—not the full Declaration. They don't include the complete list of covenants, use restrictions, or enforcement details beyond what's referenced. For the full rules, you'd need the original Declaration and earlier amendments.
