- Architectural review exemption: For Tract 3, the architectural control provisions in Article VIII, Sections 1 and 2 of the original declaration do not apply. This means the developer (Pinnacle) has separate architectural control over that tract.
- Assessment timing for builder lots: For lots in Tract 3 sold to a builder who will construct a unit for resale, assessments do not begin until the builder sells the completed unit to a homeowner. For other lots, assessments start upon deed acceptance.
- Amenity contribution fee: The developer of Tract 3 must pay $1,000 per new townhome to the HOA for access to existing amenities. A prepayment of $200,000 is due within 60 days of recording the first townhome lot, covering the first 200 units; thereafter, payment is due at each closing.
- Lot density and construction materials: The maximum number of lots/units in Tract 3 is capped at 220 (removing the previous 4-unit-per-acre limit). The requirement for brick construction on lots abutting Mallory Creek Drive has been removed.
- Membership class for Tract 3 owners: Owners of lots in Tract 3 are designated as Class E members of the HOA, with the same voting rights as other members (one vote per lot).
- What this document doesn't cover: This document does not cover general HOA rules such as pet restrictions, leasing terms, parking, or maintenance responsibilities. Those are in the main declaration, which is not provided here.
