What Ashe Island Farm's governing documents say
Ashe Island Farm is a single-family residential HOA in North Topsail Beach, NC. This document is a second amendment that replaces the entire original declaration, so it is the full rulebook for lots 2–28. It binds lot owners, not renters, and applies to owners of the numbered residential lots.
- What you own & maintain: You own your lot in fee simple, with a minimum lot size of 10 acres. The association owns and maintains the community use areas (lots 1 and 31, roads, ponds). You must maintain your own lot and any easements on it.
- Annual assessments: The annual assessment for 2023 is $1,950 per residential lot. It can increase up to 15% per year without a vote; increases above 15% require a 2/3 vote of members present. Unpaid assessments become a lien on the lot and a personal obligation of the owner.
- Architectural review: All construction, clearing, grading, and exterior changes require prior approval from the Architectural Standards Committee. The committee has 30 days to approve or disapprove; if no response, approval is deemed given. Interior remodeling and interior painting do not require approval.
- Residential use & building rules: Lots 2–28 are for single-family residential use only. One detached single-family dwelling per lot, minimum 3,300 sq ft of heated space (2,000 sq ft on first floor for multi-story). No mobile homes, double-wides, or pre-manufactured homes. Maximum height 45 feet. Setbacks: 75 ft from Stump Sound/Upgoing Creek, 50 ft from center of Hunter Heath Drive or Upgoing Road, 25 ft from side lot lines.
- Pets & animals: Dogs, cats, and other household pets in reasonable numbers are allowed, but not for commercial purposes. Pot-bellied pigs, chickens, turkeys, and swine are not considered household pets. Horses may be permitted by the association in common areas or on lots adjacent to Heath Creek, subject to town ordinances.
- Parking & vehicles: No stripped, wrecked, or junked vehicles; all vehicles must have current registration and tags. No overnight parking of trucks over one ton, mobile homes, trailers, buses, or campers on lots (except along Upgoing Road). No parking on roads. Golf carts and recreational equipment must be stored out of sight from streets and neighbors.
- Leasing & rentals: The document does not address leasing or rental restrictions. Owners may delegate use of community areas to long-term tenants and contract purchasers who reside on the property.
