Folkstone Heights is a single-family home subdivision in North Topsail Beach, NC, governed by a homeowners association (HOA). This document is the main declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lots in the subdivision. It also includes a supplement that annexes additional lots into the community.
- What you own & maintain: You own your lot and the home on it. The HOA owns and maintains common areas (e.g., roads, stormwater systems, entrance landscaping) and may also maintain certain lot exteriors if the owner fails to do so, charging the cost back to the owner.
- Leasing & rentals: Leases must be in writing and have a minimum term of at least six months. Owners must provide lessees with copies of the governing documents and notify the HOA within 10 days of lease execution.
- Architectural review: No exterior construction, alteration, or landscaping (including fences, sheds, paint colors, and tree removal) may begin without written approval from the Declarant or the Architectural Review Committee. Interior remodeling does not require approval.
- Parking & vehicles: Each lot must have a paved driveway and off-street parking for at least two cars. No inoperable vehicles, boats, RVs, trailers, or vehicles larger than 3/4 ton may be parked or stored on lots unless hidden from view in a garage or approved enclosure.
- Pets: Only a limited number of domestic household pets are allowed (limit set by the HOA). Pets must be leashed off the owner's lot, and droppings must be removed immediately. Excessive barking may require a bark-control collar.
- Home size & construction materials: Homes must be at least 1,350 square feet of heated floor space (excluding garages, porches, etc.). Exteriors must be conventional frame, wood, Hardiplank, vinyl, brick, or similar approved materials; concrete block, aluminum siding, and tar paper are prohibited. Roofs must have a minimum 5/12 pitch and earth-tone shingles.
- Assessments & fees: The HOA levies annual assessments, special assessments (with member vote), and specific assessments (for services, fines, or lot-specific costs). An initiation fee is due upon sale of each improved lot. Assessments become a lien on the lot if unpaid, with 18% interest and late fees.
- Use restrictions: Lots are for residential use only. No commercial activities, yard sales, or home businesses that are visible or bring regular visitors. No mobile homes, tents, or temporary structures. No signs except approved real estate signs. No antennas without approval. All lots must be kept neat and mowed.
