What Oyster Landing (NC)'s governing documents say
Oyster Landing is a planned single-family home community in North Topsail Beach, NC, governed by a homeowners' association (HOA). These protective covenants run with the land and bind all lot owners, their heirs, successors, and assigns. The HOA maintains common elements, enforces rules, and collects assessments. The community is subject to the North Carolina Planned Community Act.
- What you own & maintain: You own your lot and the single-family dwelling on it. You must keep your lot mowed, edged, and free of debris. The HOA maintains common elements, stormwater systems, conservation areas, and landscaped rights-of-way. Owners are responsible for driveway pipes and swales adjacent to their lots.
- Architectural review: All exterior construction, alterations, and changes (including color, fences, landscaping, and drainage) require prior written approval from the Declarant or an Architectural Control Committee. Plans are deemed approved if not acted on within 30 days of complete submission. The committee may disapprove based on purely aesthetic grounds.
- Assessments & fees: All lot owners must pay general assessments for common expenses, plus possible special assessments for capital improvements (approved by majority vote) and individual assessments for limited common elements or violations. A working capital assessment equal to one year's general assessment is due from each new owner (excluding approved builders). Late payments incur 10% interest and can lead to liens and foreclosure.
- Use restrictions: Lots are for single-family residential use only. No commercial activity, mobile homes, tents, or temporary structures are allowed. Dwellings must be at least 1,000 square feet of heated floor space, no more than 2.5 stories. No subdivision of lots except to enlarge an adjoining lot.
- Pets & animals: Household pets (dogs, cats) are allowed but not for commercial purposes. They must be leashed and not become a nuisance. No livestock, poultry, or breeding of animals. Owners must promptly remove pet waste from common elements and other lots.
- Parking & vehicles: No inoperable or unlicensed vehicles may be parked on lots. Trucks over 1-ton capacity, boats, campers, and trailers must be stored in an enclosed garage and not visible. Street parking is subject to HOA policy. No customized unsightly vehicles allowed.
- Leasing & rentals: The document does not address leasing or rental restrictions. (Check supplemental declarations or HOA rules for any rental policies.)
- Stormwater & environmental restrictions: Lots have strict limits on impervious surface area (e.g., 3,650 sq ft for lots 1–31, 3,000 sq ft for lots 32–64). Vegetated buffers, drainage swales, and infiltration trenches must be preserved. Filling, piping, or altering stormwater features is prohibited without state approval. The State of North Carolina is a beneficiary of these covenants.
