Pirates Cove is a townhome community in Swansboro, NC, governed by a homeowners association (Pirates Cove Homeowners Association, Inc.). These documents are a mix of the original Declaration of Covenants, Conditions & Restrictions (1998) and two amendments (1999 and 2013) that modify specific sections. The rules apply to all lot/townhome owners and their tenants, guests, and occupants.
- What you own & maintain: You own your lot and townhome unit. The association maintains common areas (e.g., landscaping, recreational facilities) and carries master insurance on common elements. Owners must carry their own homeowners/fire insurance (including wind/hail) and provide proof annually.
- Architectural review: Any exterior changes (buildings, fences, landscaping, paint color changes) require prior written approval from the Architectural Control Committee. The committee can deny plans for any reason, including aesthetics. Plans are deemed approved if no response within 30 days. Appeals go to the Board of Directors.
- Assessments & fees: Annual assessments are levied per lot. The initial annual assessment was $240 for townhomes (as amended in 1999). Assessments can increase up to 5% per year without a vote; larger increases require 2/3 owner approval. Special assessments for capital improvements also require 2/3 approval. Delinquent assessments accrue interest, late fees, and can lead to liens and foreclosure.
- Leasing & rentals: The original declaration does not specify a minimum lease term, but the 1999 amendment removed a prior six-month minimum. Leases are allowed, but owners remain responsible for compliance. No short-term rental restrictions are stated beyond general residential use.
- Pets: Household pets are allowed but must not exceed 90 pounds. They must be leashed when off the lot. Breeding or commercial purposes are prohibited. Owners are liable for pet acts.

Clotheslines are prohibited. Fences are not allowed except those erected by the declarant or association.
- Insurance requirements: The association carries blanket all-risk insurance on common areas and liability coverage (minimum $1M single/$3M per occurrence). Owners must carry their own homeowners/fire insurance (including wind/hail) and provide proof to the association annually. In case of total destruction, owners must decide to rebuild within 60 days or clear the lot within 90 days.
