This document is a modification that converted the property from a condominium to a townhome regime under the North Carolina Planned Community Act. It binds all owners and occupants.
- What you own & maintain: You own your individual townhome unit and lot. The association maintains common areas (if any), but you are responsible for exterior maintenance and repairs of your own unit, including utilities. The association may step in if you fail to maintain, and charge you as an assessment.
- Leasing & rentals: There is no minimum lease term; vacation rentals are explicitly allowed. Owners may lease units, but tenants must follow all rules. The board can limit or prohibit owner use of recreational facilities during rental periods. Owners must lease the entire unit, not subdivide.
- Pets: Household pets are allowed, but no pet may exceed 90 pounds. Prohibited dog breeds include Rottweiler, Doberman, Mastiff, Boxer, Bulldog, Pit Bulls, Chows, and wolf hybrids. The association may add other breeds to the prohibited list. Pets must be leashed off your lot.
- Architectural review: Any exterior changes (buildings, fences, landscaping, paint, etc.) require prior written approval from the Architectural Control Committee. The committee has broad discretion, including aesthetic grounds. If no response within 30 days, the plan is deemed approved. Owners may appeal to the board.
- Parking & vehicles: On-street parking is prohibited except for temporary gatherings. Vehicles over 7,000 pounds empty weight, motor homes, and buses cannot park overnight unless in an enclosed garage. No vehicle without a current inspection sticker. Boats and travel trailers are restricted.
- Assessments & fees: Annual and special assessments are levied per unit. Special assessments for most purposes require 51% member approval, but insurance-related special assessments do not. Delinquent assessments accrue interest and late fees, become a lien, and can be foreclosed like a mortgage.
- Use restrictions: All lots are for residential use only. Home businesses are allowed only if not detectable from outside and no client visits. No temporary structures, trailers, or manufactured homes. Fences up to 6 feet allowed with approval. No exterior antennas without approval. No tree removal without approval.
