Whispering Pines is a single-family home subdivision in North Topsail Beach, NC. These restrictive covenants run with the land and bind all lot owners. The covenants were recorded in 1986 and automatically renew every 10 years unless a majority of owners vote to change them.
- Land use & building type: Lots may be used only for residential purposes. Only one detached single-family dwelling (no double-wide or mobile homes) and a private garage for up to two cars are allowed. Dwellings cannot exceed 2.5 stories.
- Dwelling size & quality: Minimum 1,000 square feet (excluding porches, carports, steps, stoops, breezeways). For two-story homes, the ground floor must be at least 800 square feet. All dwellings must be of quality, design, and materials substantially the same or better than the first two homes built by the developer.
- Building location & lot area: Buildings must be set back at least 25 feet from the front lot line and 8 feet from side lines. No dwelling may be built on a lot smaller than 15,000 square feet.
- Nuisances & prohibited activities: No noxious, offensive, or unlawful activity; no vehicle repair or servicing; no business, trade, or profession; no farming or agricultural payments. No detached storage building or garage visible from the street unless it matches the residence's exterior. No vegetable garden in front yard or within 20 feet of side property lines. No above-ground fuel tanks visible from the street. No swine, poultry, livestock, or cattle; no commercial breeding or raising of animals.
- Pets: Household pets are allowed only if kept under the owner's immediate control when not inside a building or fence, and must not disturb other owners through loud or continuous barking or other offensive activity.
- Parking & vehicles: No truck with a load capacity larger than 3/4 ton, and no tractors (except yard tractors), may be stored or regularly parked on any lot except inside an enclosed garage.
- Temporary structures: No temporary structure, trailer, tent, shack, barn, or other outbuilding may be used as a residence. No mobile home, camper-type trailer, or any altered mobile home may be erected on any lot. No detached garage or building other than the main dwelling may be used for human habitation.
