Crescent Ridge is a planned residential townhome community in Raleigh, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners, residents, tenants, and guests, and it establishes the rules for property use, maintenance, and community living.
- What you own & maintain: You own your townhome lot and are responsible for its interior, exterior doors, windows, patio doors, driveways (beyond the garage door face), and any improvements not maintained by the association. The association maintains the common areas and provides exterior maintenance for roofs, gutters, exterior building surfaces, landscaping, and private streets.
- Leasing & rentals: You may rent your entire lot, but leases must be in writing, for a term of at least six months (except for temporary occupancy during a sale), and must require tenants to comply with the governing documents. You must notify the association of the tenant's name, provide a copy of the lease, and certify that the tenant received the rules. You remain responsible for all assessments even if the tenant agrees to pay them.
- Use restrictions: Lots are for residential use only; no business, commercial, or manufacturing use is allowed. No subdivision of lots or time-sharing is permitted. The association can enforce reasonable occupancy limits.
- Architectural review: An Architectural Control Committee (ACC) has approval authority over new construction, modifications, and alterations. You must obtain approval before making exterior changes.
- Fines & enforcement: The association can impose fines up to $150 per day for violations, suspend voting rights and common area use (after notice and hearing), and use self-help to cure violations. It can also suspend services if you are more than 30 days delinquent on assessments.
- Party walls: Walls shared between townhomes are party walls. Repair and maintenance costs are shared equally by the owners who use the wall, and disputes are resolved by arbitration.
- Common area use: All owners have a non-exclusive right to use the common areas, subject to association rules. The association can limit guests, charge fees for facility use, and suspend use rights for unpaid fines or rule violations.
