What Foxkroft's governing documents say
Foxkroft Villas is a condominium community in Moore County, NC, created in 1976 under the North Carolina Unit Ownership Act. It consists of eight units in two two-story buildings, with each owner holding an undivided 12.5% interest in the common areas. This document is the original Declaration and By-Laws, so it defines the basic ownership structure and rules for the community.
- What you own & maintain: You own the interior space of your unit, including interior walls, fixtures, and finished surfaces. The association maintains the common areas (roofs, main walls, land, walkways, parking, etc.), and you're responsible for repairs inside your unit, including internal installations like plumbing, electrical, heating, and air conditioning.
- Leasing & rentals: You may lease your unit only with prior written consent of the board of administrators, which cannot be unreasonably withheld. A copy of the lease must be provided to the board, and unauthorized leases are voidable.
- Pets: Dogs, cats, and other household pets in reasonable numbers are allowed, but they cannot be kept for commercial purposes, must be on a leash when in common areas, and any pet causing a nuisance must be removed.
- Use of units: Units must be used only as private dwellings for the owner, family, tenants, and social guests. No immoral, improper, offensive, or unlawful use is permitted.
- Exterior changes & structural modifications: No improvements, alterations, or changes to the exterior of buildings or common areas are allowed without written consent of the Declarant and the Association. Structural modifications inside your unit require written notice to the Association, which has 30 days to object.
- Parking & vehicles: Boats, campers, mobile homes, motorcycles, and similar vehicles cannot be permanently kept or stored in common areas. Bicycles and golf carts are permitted in transit.
- Assessments & finances: All owners must pay monthly assessments prorated by their percentage interest (12.5% each) to cover common expenses, including insurance, taxes, water/sewer, grounds maintenance, and reserves. The board collects assessments and manages the budget.
- What this document doesn't cover: This is the original 1976 Declaration and By-Laws; it does not include current fee amounts, specific pet limits (only 'reasonable numbers'), or any later amendments. It also doesn't cover rules about noise, short-term rentals, or age restrictions.
