This is a set of restrictive covenants for Parkside II, a single-family home subdivision in Chapel Hill, NC, governed by a homeowners association (HOA). It applies to lot owners and sets rules for what you can build, how you use your property, and what you must maintain.
- Land use & building type: Lots are for residential use only. Each lot may have one detached single-family home (max 2.5 stories), a garage for up to 3 cars, and incidental outbuildings. Minimum heated area is 1,400 sq ft for one-story homes, or 800 sq ft on the first floor of a two-story home.
- Setbacks & house placement: Homes must be built within the building envelope shown on the recorded plat and comply with Chapel Hill zoning. On corner lots, the home may face either street; otherwise it must face the street it abuts.
- Fences & walls: Fences cannot be closer to the street than the front or side setback lines. Chain-link or other metal fencing is prohibited. All fences must meet zoning and be approved by the HOA per the Declaration.
- Parking & vehicles: Vehicles may only be parked on improved surfaces (garage, driveway, carport, or paved pad). Driveways and pads must be concrete. No campers, tractor trailers, commercial vehicles, or boats on streets; boats on lots must be screened from the street. Abandoned or inoperative vehicles cannot be visible from other lots, streets, or common areas.
- Pets & animals: No livestock or poultry. Dogs, cats, and other household pets are allowed but cannot be kept for commercial purposes.
- Nuisances & business activity: No noxious or offensive activities. Businesses are not allowed on lots unless permitted by the Chapel Hill Board of Adjustments.
- Signs & antennas: Only one 'for sale/rent' sign (max 10 sq ft) and political signs (max 10 sq ft, up to 60 days before an election, removed within 2 days after) are allowed. Satellite dishes are limited to 2 feet in diameter, must be on the side away from the street, and screened from view. No free-standing towers.
- Exterior maintenance & appearance: Owners must keep lots orderly and homes in good repair. Destroyed structures must be rebuilt or removed within 12 months. No clotheslines, no above-ground pools (except small inflatable wading pools), and trash must be hidden from street view. Trees larger than 6" in diameter (measured 3' off the ground) cannot be removed without HOA approval.
