What Governor S Point Townhomes Homeowners Association Inc's governing documents say
This is the declaration of covenants, conditions, and restrictions for Governor's Point Townhomes, a townhome community in Raleigh, NC. It establishes a homeowners association (HOA) that all owners automatically join, and it governs the use, maintenance, and assessment of the properties. This document is the full rulebook for the community, binding on all current and future owners.
- What you own & maintain: You own your townhome lot (fee simple) and share common areas like private streets, open space, and storm drainage facilities. The association maintains the exterior of your home (roof, gutters, exterior surfaces, trees, shrubs, grass, walks) and the common areas, but you are responsible for interior maintenance and any damage caused by your negligence or certain perils.
- Assessments & fees: All owners pay annual assessments (initially capped at $1,000 per lot, with annual increases up to 10% without a vote) and may pay special assessments for capital improvements (requires 2/3 vote). Assessments are a lien on your property if unpaid, with 8% annual interest and collection costs.
- Architectural review: You must get written approval from the HOA board or an architectural committee before making any exterior changes, including buildings, fences, walls, or alterations. Plans must be approved within 30 days or approval is deemed given, and the HOA may charge a review fee.
- Parking & vehicles: Each lot is entitled to use up to two parking spaces. The association can regulate or prohibit parking of boats, campers, trailers, and commercial vehicles on common areas, and may designate where such vehicles can be parked.
- Use restrictions: Properties must be used only for residential purposes. No obnoxious or offensive activities are allowed, and the HOA can make rules about front and side yards and common areas. You need permission to plant vegetation in the front yard.
- Party walls: Shared walls between townhomes are governed by party wall rules: repair costs are shared proportionally, and disputes go to arbitration. If you cause damage to a party wall, you bear the cost.
- Leasing & rentals: The declaration does not restrict leasing or rentals, but owners can delegate their common area use rights to tenants. Tenants must follow the same rules.
- What this document doesn't cover: This document does not specify pet rules, age restrictions, or rental minimums. It also does not list current assessment amounts or specific amenities; those are set by the board and may change.
